Faces, those wishing to obtain permission to permanent residence in the Republic of Lithuania, must pass exams on knowledge of the state language and the basics of the Constitution. But there are categories of people, to whom this requirement does not apply. Who are they?
Article, which regulates the grounds for obtaining and replacing permanent residence, - this is an article (article) 53 Law on the Legal Status of Foreigners (UTPĮ). Let's take a closer look at it.
The first part (part) tells us about foreigners, to whom permanent residence permit can be issued:
- 1. who has the right to restoration of Lithuanian citizenship;
- 2. who is of Lithuanian origin;
- 3. who came to live with a Lithuanian citizen as a member of his family;
- 4. who lost Lithuanian citizenship, but lives in Lithuania;
- 5. minor, born in the Republic of Lithuania, and his parents or one of them are citizens of Lithuania, whose place of residence is declared in Lithuania, or have permanent residence;
- 6. minor, not born in the Republic of Lithuania, and his parents or one of them are citizens of Lithuania, whose place of residence is declared in Lithuania, or have permanent residence;
- 7. who has refugee status;
- 8. legally resided in the Republic of Lithuania without interruption for the last 5 years, having a document, giving or confirming the right to reside in the Republic of Lithuania or a national visa;
- 81. resided in an EU country without interruption for the last 5 years, of which no less 2 without interruption - in Lithuania, and had a residence permit via UTPĮ 40 art. 1 d. 41 p.;
- 82. resided in an EU country without interruption for the last 5 years, of which no less 2 without interruption - in Lithuania, and had a residence permit as a family member of a foreigner with a temporary residence permit (EU blue card);
- 9. in case, provided for 2 art. law on the implementation of UTPĮ;
- 10. resided in a foreign country for no longer than, specified in UTPĮ 54 art. 1 d. 3 And 4 p., has not acquired long-term resident status in another EU country, and before living in a foreign country lived in Lithuania and had permanent residence.
Now let's see, what does the part about having to take exams say?, namely part 6:
Permanent residence permit, given on the basis of points 8-82, may be issued, if the foreigner has passed the exam in the state language and the exam on the basics of the Constitution. The procedure for examinations and issuance of certificates is established by the Government of Lithuania.
Also part 8 tells us, that for some persons the point 6 not applicable:
- older 75 years;
- persons with disabilities 0-25%;
- persons with special needs, legally established;
- persons with severe chronic mental and behavioral disorders;
- children and foreigners, whose previously existing permanent residence permit was canceled on grounds, specified in UTPĮ 54 art. 1 d. 3 And 4 p.;
