Amended law: food allowance for asylum seekers

Asylum seekers, living in their chosen place of residence, acquired the right to receive food benefits. Since 1 January 2025 year the change came into force “Law on the Legal Status of Foreigners”.

Change Nr. XIV-2673 from 30 May 2024 affected by the article 71 “On the rights and obligations of asylum seekers”. In particular, the wording of the part has changed 2¹, regarding the right to receive food benefits.

What has changed?

Asylum seekers, temporarily residing in a refugee reception center, in order, established by the Minister of Social Protection and Labor, are entitled to a food allowance in the amount of 60 percent of income, state-supported, if food service is not provided. Let us remind you, that according to the article 71 parts 1 point 1 and article 79 parts 2 UTPĮ, in accordance with the procedure established by law, applicants can reside in a place of their choice.

That is, now not only for those, who lives “in the camp”, but also for those, who exercised the right to live independently, the right to receive a food allowance is granted in the amount of 60% from income, state-supported (State-supported income or VRP). At the beginning 2025 year it is equal 221 EUR. In this case, the benefit is allocated only if, if food service is not provided.

To receive such help, you must contact the Reception and Integration Agency. This is where you need to send your request. in free form about the provision of such benefits.

Documents will also need to be attached to the application., which prove, that you are eligible to receive benefits, that is, that you are an asylum seeker. For this you need:

• Alien Registration Certificate.
• Deciding whether to accept your asylum application.
• The decision to allow you to reside in a place of your choice.

All these documents are provided by the Migration Department. The last two are issued after your asylum application is accepted.

A similar change was applied to the 3rd part of the article 71, which talks about monthly cash assistance in the amount of 10% from VRP. This benefit is provided from the date of filing the application..
